and Regulations Update With David Brock

Geralyn Friedrich of the Macomb PAC attended the meeting.
Mr. Brock's responses are listed in italics, these were written as he gave them
and Geralyn was working with a fellow PAC Member and did her best to report
exactly what he said. Here is her report:
David Brock did the State Department of Special Education PowerPoint presentation that a lot
of us have seen given.
After the presentation, it was question and answer time, below are some comments.
- There will be an addendum in regards to about six of the rules and they should come out in
July.
- Rules 1809 and 1810 WILL come back. It was never an attempt to remove the money, it was misunderstood, and they will be
back. (Mr. Brock stated this twice.)
- Every time the rules are cut, it lessens the burden on government.
- IEPs are in charge of programs, programs are not rule based or driven.
- The rationales are the closest to the truth we could come.
- On talking about extended school years for SXI, SMI, Mr. Brock said, Extended school years are IEP issues and
should be for ALL kids.
Some questions asked and Mr. Brock’s responses:
- What about the task force not matching up with some of the proposed rules, how do you explain that?
- Just because the task force was there and referred to, didn’t mean they needed to
match.
- How do you expect the groups involved in the ratio approval to ever agree on the ratio?
- How will the department of education make the process go smoothly when
the rules are final, and how long will it take?
- About 1-2
years until districts and ISD will have to have their plans ready and comply.
- Can the office of regulated reform have a say in these rules?
- Office of regulated reform is a group of lawyers who will approve or not approve these rules, and right now,
they like these rules.
- Will the proposed rules be re-written or just parts of it based on public
comment?
- Can not just add new rules, would have to have public comment on any new changes, like the
addendum coming out will have public comment time.
- How will parents and stakeholders be trained in the new rules once final?
- Our advocacy
groups will train, they get money from us, so they will do the training, like
ARC, CAUSE, MP&A.
- Will the ratio cause bigger class sizes?
- Needs to be decided by the superintendents and the others we talked about in the
ISD.
- 0-3 is an issue, how will this 1 area of disability affect them in
service provided?
- Well, we don’t know much about that diagnostic stuff, we are looking to you folks for help
in that area.
- Who will pay for an Aide in an inclusion situation?
- The IEP will decide if it should come out of the general fund, or special ed
fund.
- How will you guarantee a student of certain impairment will be with a
teacher endorsed and certified in that impairment?
- That will be the district’s responsibly to go and find someone and contract
them.
